Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you and DIGITALSTALK PRIVATE LIMITED (“DIGITALSTALK,” “we,” “us,” or “our”), an Indian company and the maker of Sently. Please read them carefully. They cover important things — including that Sently is a helpful safety tool but is not a guarantee, and how subscriptions and billing work through Apple.

1.Acceptance of these Terms

By downloading, accessing, or using Sently, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Service. If you are using Sently on behalf of someone else (for example, setting up the family safe-word tool for your household), you confirm you are authorized to accept these Terms for that use.

3.No guarantee & not professional advice

Please read this carefully.

Sently is a safety tool designed to help you spot risks — not a guarantee of safety. Scam tactics, breaches, and threats change constantly. Sently cannot and does not guarantee that it will detect every scam, phishing attempt, malicious link, data breach, or other threat, or that every alert or result it gives is accurate. It may miss real threats (false negatives) and it may flag safe things as risky (false positives).

Sently is not a substitute for professional advice. Nothing Sently provides constitutes legal, financial, security, or other professional advice. Always use your own judgment and, for important decisions, consult a qualified professional. In an emergency, or if you believe you are a victim of fraud, contact your bank, the relevant authorities, or appropriate professionals directly.

4.Eligibility & age

You must be at least 18 years old to use Sently, or the age of majority where you live, unless you use it under the supervision and consent of a parent or legal guardian who agrees to these Terms. Sently is not intended for children under 13 (or under 16 where a higher age applies), and we do not knowingly permit them to create accounts. You are responsible for ensuring your use of Sently is lawful where you live.

Paid plans typically include a 7-day free trial. Prices are indicative and may vary by region, currency, and over time; the exact price, billing period, and any trial terms are shown to you at purchase in the App Store.

We may suspend or limit access if we reasonably believe your use violates these Terms or puts the Service or others at risk.

8.Third-party services

Sently relies on third-party services to work. These include Apple (App Store, in-app purchases, and push notifications), Cloudflare (Workers compute and the D1 database that hosts our backend, plus URL Scanner for link reputation), Google (the Gemini API, which receives the text you submit for an AI deep check, and Safe Browsing, which receives URLs you check), Resend (delivery of sign-in code emails), XposedOrNot (breach-data lookups), and Optery (data-broker removal, coming soon).

Using a feature that depends on one of these providers means data is shared with them as described in our Privacy Policy, and your use may also be subject to their own terms and policies. We are not responsible for third-party services, their availability, or their content, and we do not control the results they return.

If you add a family member to the safe-word tool, you confirm you have that person’s permission to give us their name and email address, and that you will tell them their details are stored in Sently.

9.AI features disclaimer

Some Sently features use artificial intelligence, including the optional AI deep check (powered by Google’s Gemini) and the AI companion “Pax.” AI can be wrong. Its assessments are probabilistic and may be inaccurate, incomplete, or out of date, and it may occasionally produce results that are misleading. Treat AI output as one input, not a verdict.

The deep check is third-party AI processing: the text you submit is transmitted through our server to Google’s Gemini API for analysis. In the App this provider is described as “a third-party AI service” and named in our Privacy Policy. The feature is off until you give explicit permission in the App, and you can withdraw that permission at any time under You → Cloud AI analysis; Sently’s on-device checks keep working either way.

Always verify independently. Do not rely solely on an AI result to decide whether something is safe, to send money, to share sensitive information, or to take any significant action. When in doubt, verify through official channels and, for important matters, consult a qualified professional.

10.Disclaimers & warranties

To the fullest extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory. We specifically disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that it will detect or prevent any particular scam, breach, or threat, or that results will be accurate or reliable.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. In that case, such warranties are limited to the minimum permitted by law.

11.Limitation of liability

To the fullest extent permitted by law, DIGITALSTALK PRIVATE LIMITED and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service — including any failure to detect a scam, breach, or threat — even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us (via Apple) for the Service in the 12 months before the event giving rise to the claim, or (b) USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability under mandatory local consumer-protection law.

12.Indemnification

You agree to indemnify and hold harmless DIGITALSTALK PRIVATE LIMITED and its personnel from and against any claims, liabilities, damages, losses, and reasonable expenses (including legal fees) arising out of or related to your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party. This does not apply to the extent a claim results from our own breach of these Terms or our unlawful conduct.

13.Termination

You may stop using Sently at any time and delete your account. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends. Sections that by their nature should survive — including disclaimers, limitation of liability, indemnification, and governing law — will continue to apply. Ending your subscription is handled through your Apple ID settings (see §6).

14.Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles, and you agree to the exclusive jurisdiction of the courts located in India for disputes arising out of or relating to these Terms or the Service.

Your local consumer rights still apply. Choosing Indian law does not remove the protection of any mandatory consumer-protection rights you have under the law of the country where you live. Where those local rights conflict with these Terms, the local mandatory rights prevail.

15.Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you in the App or by email. If you continue to use Sently after the changes take effect, you accept the updated Terms. If you do not agree, please stop using the Service.
